The Notaries of Europe open a new information website for the general public > Authentic instruments in Europe
Produced with the financial support of the European Commission (EU Justice Programme 2014-2017) and the support of the European Notarial Network, this site provides information on the probative value of authentic instruments drawn up in the 22 EU countries where notaries are active in matters of succession and family law. This information is available in French, English and the language of the country concerned.
Facilitating access to law: a commitment by Notaries of Europe
Making justice more efficient in Europe is a priority objective for the Notaries of Europe. This is why they provide European citizens with resources that enable them to better understand their rights. The following websites, which are the result of their joint work, provide information to thousands of citizens every year:
Establishing authentic instruments: the notary’s mission
With the “Authentic acts in Europe” website, the Notaries of Europe wish to raise public awareness of the essence of their function: to confer authenticity on the legal acts and contracts they draw up for their clients. Notaries carry out this task on behalf of the State, which grants them the status of public officer. Like court decisions, authentic instruments are enforceable, which allows the contracting parties to enforce their obligations directly without having to go to court. Moreover, unlike private deeds, the authentic instrument has a higher probative value which is binding on judges, the administration and third parties.
